论人民检察院应如何对精神病人的强制医疗程序进行监督

In the case of frequent violence of mental patients,the Amendment of Code of Criminal Procedure specifically provides for compulsory medical procedures for the mental patients,which solved the problems in the judicial practice,not only protected the personal and property safety of others and maintain the social order,but also protected the mental patients.But the provisions of the Amendment of Code of Criminal Procedure were relatively brief and lack of relevant experience in the judicial practice.It is particularly important for the People's Procuratorate to supervise in accordance with the law in order to ensure the smooth and effective implementation of the compulsory medical procedures of mental patients.%在精神病人暴力伤人案件频发的情况下,刑事诉讼法修正案专门规定了精神病人的强制医疗程序,解决了司法实践中亟待解决的问题,不仅保护了他人人身财产安全,维护了社会秩序,同时也是对精神病人本人的保护。但是刑事诉讼法修正案的规定较为简要,同时缺少相关的司法实践经验,为了保证精神病人的强制医疗程序顺利有效执行,人民检察院的依法监督就显得尤为重要。
