新闻自由与司法独立关系的法理探析

摘要

Independence of jurisdiction and freedom of press are relationship between the opposition and the unification , harmo-ny and conflicts coexist .Apart from the high degree of consistency on the target , their intrinsic value conflicts , which leads to the tension between the judicial activity and the news media .The paper analyzed the complex relations between independence of juris -diction and freedom of press from the perspective of jurisprudence , which should be taken as the presupposition for our country to carry out relevant judicial reforms .%新闻自由与司法独立之间是对立与统一、和谐与冲突并存的关系。二者在终极目标上具有高度一致性的同时，其内在价值的冲突不可避免引致司法活动与新闻舆论关系的紧张。从法理学的视角来探析这两者之间复杂关系，应当成为我国进行相关司法改革的认识前提。
