论恐怖主义犯罪刑事管辖的几个相关问题

刑事管辖是追诉犯罪的必要前提。恐怖主义犯罪作为一种多因素影响下的国际犯罪，其管辖问题具有一定的特殊性。在厘清基本概念的基础上，从国际法和国内法两个层面分析恐怖主义犯罪之管辖，进而提出我国相关立法的完善对策，有助于在法治视野下理解恐怖主义犯罪管辖相关问题。%The criminal jurisdiction is a necessary prerequisite for criminal prosecution. As an international crime under influence of multi-factors, the criminal jurisdiction of terrorism crimes shows some particularity. On the basis of clarifying the basic concepts, the paper analyzes the jurisdiction of terrorism crimes from two aspects of international law and domestic law, and then puts forward the countermeasures to improve the relevant legislation of China, which is helpful to cognize the related problems of jurisdiction of terrorism crimes in the view of the rule of law.
