试析美国联邦政府的废约权力之争--以“戈德华特诉卡特案”①为例

发生在中美建交过程中的“戈德华特案”，涉及美国国会与总统关于废除对外条约的权力分配问题。通过借助此案的分析，不仅可以了解这一争议的根源之所在，同时也会加深对美国政府三权制衡机制的进一步理解。%The lawsuit Goldwater against Carter, which took place during the Sino-U.S. Diplomatic-tie establishment process, concerns the distribution of the power-to-abolish-foreign-treaty between the Congress and the Presidency. An analysis of the lawsuit will be helpful to understand the reason of controversy and to learn more about the three-branch balance mechanism of the U.S. Government.
