清末“新政”改革首先通过建构现代法治，开启了政治现代化转型的进程。然而辛亥以后，刚刚起步的法治体系在接踵而来的政治事件中屡遭冲击，使社会精英将政治现代化的期望转而寄予以“德先生”为名的直接民主。由此我们看到，在新文化和五四运动中，先后于理论和实践两方面形成了民主僭越法治的局面，对法治现代化进程造成了深远的影响。%The rule of law modernization is one of the basic tasks of political modernization in modern China.At the begin-ning of the 20th century,the Qing government's New Deal reform first opened the transformation process.But after the Xinhai Revolution,the social elites put their expectation of political modernization to the direct democracy named Mr De-mocracy .In the new culture movement and the May Fourth movement,they have successively formed the situation of democratic trespass in the rule of law in the aspects of theory and practice.
