我国合议庭机制的运行困局及破解之策--以基层法院民事案件审判为研究样本

The collegial panel is the most important judicial organization in China, the collegial system is the most important way of trial in our country, the collegial system function is implemented through the operation of the collegial panel, the stand or fall of collegial panel operation state not only affects the quality of the trial of cases, but also affect the trial of the system construction of our country. Through to the modern judicial power operation law, examine our country's judicial practice, many problems exist in the operation of the collegial system in our country, urgently needs to be perfected, collegial system run efficiently requires scientific mechanism design, to benign operation of the judicial power.%合议庭是我国最重要的审判组织，合议制是我国最重要的审判方式，合议制功能的发挥正是通过合议庭的运行来实现的，合议庭运行状况的好坏不仅影响着案件的审判质量，同时也影响着我国的审判制度建设。通过对现代化审判权运行规律的探寻，考察我国的审判实践，发现我国合议制的运行存在着诸多问题，对此亟需完善合议庭工作制度，设计合议制高效运行的机制，保障审判组织的良性运转。
