网络反腐的法律思考

网络反腐存在的问题包括缺乏相应的法律法规的规制、影响司法公正、侵害人身权利等。造成网络反腐存在问题的主要包括以下几个方面的原因：法律法规不健全，监管不到位，非理想因素的存在。解决网络反腐存在的问题要做到以下几个方面：加强网络反腐的法治化建设，实现有法可依，在立法、执法、司法等方面保障网络反腐的法治化建设；充分发挥政府的主导作用，加强公民的法治观念；实行实名制与匿名权相结合。%Network anti-corruption has such problems as the lack of corresponding laws and regulations, violation of justice, and the infringement of personal rights. The factors contributing to the problems are imperfect laws and regulations, insufficient supervision, and non-ideal things. The problems can be solved by strengthening the legal construction of network anti-corruption so that there are to be followed. Legal construction of network anti-corruption is guaranteed through legislation, law enforcement, and judicial practice. Governments should fully play their roles, improve citizens' awareness of lawful governing and combine the system of citizen using genuine name with the right to be anonymous.
