故意“误拆”以“误拆”之名行强拆之实，事实上可能构成故意毁坏财物罪。在故意“误拆”的情形下，无论权力大小，权力寻租的背后，必然存在滥用职权、玩忽职守等职务犯罪行为。故意“误拆”中职务犯罪存在的主要原因在于政府个别领导片面追求政绩、具体的拆迁实施单位不当地追求经济利益、监督机制不力以及官商相互勾结导致腐败，致使职务犯罪滋生。彻底避免故意“误拆”，应该科学合理配置权力，改变干部考核机制，让基层官员有升迁的正常途径；同时加强媒体舆论监督，发动舆论监督的人民战争，让故意“误拆”没有办法遁形；建立官员财产申报制度，从根本上避免拆迁权力寻租，强拆而非“误拆”贪官的保护墙。%Deliberate “demolition by mistake” is a forced demolition in the name of “demolition by mis-take” ,w hich may constitute a crime of intentional destruction of property in practice .In the case of delib-erate “demolition by mistake” ,regardless of the level of power ,seeking after power ,there must be abuse of power ,dereliction of duty and other crimes .The main reasons of deliberate “demolition by mistake” are that certain government cadres unilaterally pursue achievements ;the demolition units improperly pursue the economic interests ,poor supervision mechanism and collusion between officials and businessmen .To completely avoid deliberate “demolition by mistake” ,we should scientifically and rationally allocate pow -er ,change the cadre examination mechanism ,so that grass-roots officials have the normal way of promo-tion .Meanw hile ,strengthen the media and public opinion supervision ,and launch people’s war of public opinion ,so that there is no way to hide crimes .Establish the official property declaration system ,w hich is a fundamental way to avoid the seeking rent of demolition power .Demolition is not the protective wall of deliberate “demolition by mistake” corrupted officials .
