法律规定不一往往引致多样的司法导向,影响社会的安全稳定且有悖于依法治国的法治理念。有关第三人侵权而认定的工伤情形,在司法实践中审判不一。对该问题的探究主要存在替代、选择、补充、兼得四种模式。相比以上四种模式,选择性兼得模式是较为理想的救济模式,契合分配正义与矫正正义,应当在实务中落实。%Inconsistent legal provisions often result in various judicial guidance,influence social security and stability and is contrary to the notion of ruling by law. As to the case of work-related injuries brought by the tort of third party,the trial results do not agree in judicial practice. For the research on the problems there mainly exist four modes:alternative mode,optional mode,supplementary mode,compatible mode. Among those four modes, the optional compatible mode is the more ideal relief mode,which fits the distributive justice and corrective justice, and should be used in practice.
