试论我国财政补贴的法律规制

摘要

目前在我国，财政补贴出现了诸多问题。其中最主要的是缺乏法律规制。文章分析了财政补贴现阶段其现状和问题，主要有财政补贴边界不清、财政补贴依据重政策轻法律、缺乏程序规范等。并解释了财政补贴法律规制的必要性，最后在之前分析论证的基础上提出了我国财政补贴法律规制的建议。%In China,financial subsidies have many problems in recent years.One of the most important problems is the lack of legal regulation.The paper analyzes its status quo and current problems:finan-cial subsidies are not clear;legal basis is deficient;financial subsidies lack in procedure law and so on.Then it explains the necessity of legal regulation for the financial subsidies,and gives suggestions on perfecting the relevant legal system based on the former demonstration.
