农民工权益保护现状及对策研究

摘要

我国的二元户籍制度一直是妨碍城镇化的主要制度缺陷,是进城农民面临各种歧视的基础性制度。尽管在新劳动合同制度下,农民工权益的保护和完善都有了长足进步,但对于这样一个庞大的弱势群体,没有专门的立法保护,或在现有法律制度框架下没有有效的配套措施加以保证实施,很难从根本上摆脱农民工所面临的困境。因此,我们应借鉴发达国家在农民工权益保护方面的立法经验,规范劳动合同的签订程序,规定农民工与用人单位关于劳动合同签订方面的相互权利义务,才能从根本上为维护农民工的合法权益提供法律依据。此外,只有全社会的共同关注,并通过政府及相关职能部门的有效介入,才能彻底改变现状。%Double census register system is the flaw which handicapped the urbanization.It is the fundamental system who the farmers face the various discrimination in the urban.In spite of new labor contract system,the protections of labor rights and implement have a long progress.If we have no special legislature protection and no efficient measures,we could not get rid of the labors straits for the huge weakness group.Therefore,we should use the experience of other countries for reference in legislature experience and standard the procedure of labor contract and stipulate the rights and obligation between the labor and employer.It provide law basis for labor rights.Moreover,as long as the whole community should focus on and functional institution put into it effectively,the situation have completely transformed.
