对监狱罪犯劳动价值的现代性思考

摘要

The value of law is based on the relationship between the people and the law.Taking the value of prisoner's labor into the consideration of value of the law is an important subject for the study of law.First,labor in the prison has difference from ordinary social labor;Second,the criminals' prison labor value is the premise of the existence of the prison,and from first to last has infiltration of law,therefore,studying the criminals' labor value is inseparable from the law,similarly,law research should not be lack of value of labor;Third,the criminal's labor value judgment should be consistent with the context of the times,and the labor value of modernity.%法的价值以法与人的关系作为基础。将罪犯劳动的价值问题置于法的价值范围考虑,是法律研究的重要课题。首先,监狱组织罪犯劳动的性质有别于社会普通的劳动;其次,罪犯劳动价值是以监狱的存在为前提的,而监狱自始至终都渗透着法的属性,因此,研究罪犯的劳动价值离不开法,同样,法学研究也不能缺少对罪犯劳动价值的研究;第三,对罪犯劳动价值的评判,应符合时代语境,并进行劳动价值的现代性考量。
