大数据时代公共安全保障与个人信息保护的冲突与协调

摘要

不同于通信和电话时代,大数据时代动态的信息数据流随着互联网的传播溢出了公与私的边界.传统意义上的个人信息保护已经不仅仅局限于私法领域隐私权的保护范围,开始向公法及社会治理领域扩展和延伸.随着大数据平台作为一种社会治理创新模式在公共安全领域的大范围使用,出于保障公共安全的需要,个人信息被广泛收集和利用,容易导致保障公共安全与保护隐私权之间产生冲突.为解决这一现实冲突,在推进社会治理现代化的过程中全方位加强个人信息保护将成为必然的发展趋势.%Different from the mailing and telephone era,in the big data era the dynamic information data flow crosses the boundary of the public and private with the development of the Internet.Protection of the individual in-formation in the traditional sense is not confined to the privacy protection scope defined in the private law.Instead, it is expanding to the public law and social governance.As an innovative model of social governance,the big data platform is applied tremendously in the public security.The big involvement of the collection and usage of private information for the purpose of the public security may easily lead to the conflict between the public security protec-tion and privacy protection.To solve this problem,it is necessary to enhance the privacy protection in the process of the modernization of the social governance.
