中国外汇保证金交易对法制的影响

摘要

Foreign Exchange Margin Trading (FEMT) has become an important financial product as one of financial derivatives. In Western developed countries, FEMT is a significant part of financial markets, and with good legal regulation systems and supervision measures, it can protect very well the investors’ rights and interests. But in China, FEMT is still ille-gal for many reasons. Without legal regulation systems and supervision measures, the investors’ rights and interests cannot be protected, and thus China’s FEMT is always in a blind and chaotic developing state. FEMT is promoting legal prosperity and development. So China should decontrol FEMT, and make legal policies and establish regulatory systems about it.%外汇保证金交易作为金融衍生产品的一种，已成为一种重要的金融理财产品。在西方发达国家，外汇保证金交易是金融市场中的重要组成部分，并具有相对完善的法律和监管措施对外汇保证金交易进行规制，投资者的权益能得到很好的保护；而在我国，外汇保证金交易至今仍然处于灰色地带，由于各种原因外汇保证金交易几经波折至今依旧没有合法化，没有相关的法律法规对外汇保证金交易行业进行规制，也没有相应的监管措施，投资者权益无法得到保护，国内的整个外汇保证金行业一直处于盲目和混乱的发展状态。外汇保证经交易能够促进法制的繁荣发展，我国急需放开外汇保证金交易，急需制定外汇保证金交易的各种监管制度和相关法律制度。
