非法证据排除规则中辩护方的证明责任和证明标准

The exclusionary rule for illegally obtained evidence of PRC has regulated that defendant should provide relevant clues and materials while ifling a motion to exclusion.However,the uncertain standard of proof of the defendant has become one of the major obstacles that hinder the law enforcement. In order to bring the exclusionary rule into full play, it is necessary to make a comprehensive analysis on the relevant regulations of different countries and regions in combination with the judicial practice of China to make clear of the defendant's standard of proof in the exclusionary rule for illegally obtained evidence.%我国非法证据排除规则规定了辩护方在申请非法证据排除时应当提供相关的线索和材料,但是对于提供相关线索和材料应该达到怎样的标准,并没有一个统一的规定.这就导致在司法实践中出现证明标准过高,非法证据排除启动困难,或是证明标准过低,非法证据排除滥用的情况出现.因此,有必要对非法证据排除规则中辩护方提供线索和材料行为的性质进行定性,并结合国内外的相关规定来明确其所应达到的标准,以更好地发挥非法证据排除规则的作用.
