模拟审判的评估研究

         

摘要

模拟审判属于法律教育的实践教学方式,评估是对该实践教学的过程监测与质量控制手段。基于模拟审判主客体间的交互性、复杂性,评估的维度多元化:以评估的目的论,宜用发展性评价或形成性评价,以考察学生潜能开发度、目标设置合理度;以评估的主客体论,主体有教师与学生,客体即模拟审判本身;关于学生的评估维度关涉知识与技能、程序与实体、理念与思维;关于教师的评估维度关涉诉讼构造释明、案件争点剖析、角色立场解读、实务技能评论;评估的方式有观察与访谈、测量与阅档、座谈与个案研究。评估的本质是作出价值判断。%Mock trial law education belongs to the practice teaching way,evaluation is the practice teaching of the process monitoring and quality control measures.Based on the interaction,complexity,and the dimension of the evaluation to evaluate the diversified between subject and object mock trial.For that purpose of the evaluation,appropriate is used development-oriented evaluation or formative assessment study students potential development degree,goal setting reasonable degree;In the evaluation of the subject and object,subject is teachers and students,the object that is itself-the mock trial.The assessment dimensions on students with regard to the knowledge and skills,procedures and entity,idea and thinking;The evaluation about the teacher with regard to the lawsuit structure explaining,case issue analyze,role position interpretation,practice skills comments.Evaluation method has observation and interviews,measurement and read a file,discussion and individual tracking.The essence of evaluation is a value judgment.
