论行政审批与特定财产权转让合同的效力

     

摘要

未经行政审批的特定财产权转让合同的效力问题,在理论和实务界均存在较大争议。以审判实践为依托,分析检讨涉行政审批合同纠纷同案不同判之现象;从行政审批的性质和目的出发,分析行政审批对特定财产权转让合同效力的影响,以及违反报批义务应承担的法律责任;最后,就司法权与行政权之界限区分以及涉行政审批之合同效力规制提出相应建议,以期对规范司法和完善我国行政审批制度有所助益。%There is great controversy both in theory and practice on the contract validity of the specific property transfer without administrative examination and approval .Based on the trial practice , this article first analyzes and review s contract disputes of administrative examination and approval over different codefendant phenomenon .Then from the nature and purpose of the administrative examination and approval ,it analyzes the impact on the contract effectiveness of the transfer of specific property rights ,and the legal responsibility that should be taken for breach of the obligation . Finally , it discusses the boundary of judicial power and administrative power ,and puts forward corresponding suggestions to the effectiveness of the administrative examination and approval regulation in order to standardize the jurisdiction and help to improve our administrative examination and approval system .
