基于技术转移的国防专利定密机制研究

摘要

There are two main obstacles for the defense patents transferred to civil field which in-clude the relatively high classification levels of secret and the inappropriate setting of secret classifica-tion level.This paper,based on the analysis on the practical necessity of the reconstructing of setting mechanism of the defense patents secret classification level,in accordance with the principles of na-tional confidentiality law and regulations on national defense patents,in the respects of establishment of confidentiality advisory commission,secrete classification level setting,process of secret classifica-tion level setting and etc,designs a national defense secret classification level setting mechanism based on technology transfer and proposes supporting measures in the respects like re-determining the posi-tions and roles of national defense IP institutions in confidentiality works,making clear the obliga-tions and liabilities of secret classification level setting units,establishing the decryption mechanism and intermediate service system.%定密偏高、非密错定是制约国防专利向民用领域转移面临的主要阻碍。在分析国防专利定密机制重构的现实必要性基础上，以国家保密法和国防专利条例为根本遵循，从保密顾问委员会的建立、定密依据以及定密流程等方面，设计基于技术转移的国防专利定密机制，并从国防知识产权机构在保密工作中的地位和作用的重新确定、定密单位的义务和责任的明确，以及解密机制和中介服务体系的建立等方面提出了配套措施建议。
