论法治社会之多元法律文化建设

摘要

Under the rule of law in China,there are three different legal cultures, legal culture of Marxism, Chinese traditional legal culture and legal culture of Western. It is important to create a good atmosphere for the social construction of legal culture under the rule of law to how to deal with these three legal culture and their re-lationships. We should uphold and develop legal culture of Marxism, which is the most important,and explore contemporary interpretation of traditional Chinese legal culture, and learn and absorb the outstanding achievements of Western legal culture.%当代中国法治社会中，存在着三种异质性法律文化，即马克思主义法律文化、中国传统法律文化和西方法律文化。这三种历时性的法律文化以冲突的形式和共时性的形态存在于当今意识形态中。应处理好这三种法律文化及其相互关系，从而为我国法治社会建设创造良好法律文化氛围。应当坚持和发展马克思主义法学为主导，立足于重视和发掘中国传统法律文化的当代解读，同时借鉴和吸收西方法律文化的优秀成果，从而谱写法治中国的新篇章。
