基于正当程序的高校学生纪律处分权的行使

摘要

Colleges and universities,when taking disciplinary measures against students,often violate to a varying degree students'legitimate rights and interests,especially their procedural rights to par-ticipate in the proceedings against them,causing numerous disputes.This occurs because colleges and universities tend to emphasize the entity over the procedure and the result over the evidence.The paper stresses the importance of the idea of rule of law and the value of procedural justice and urges colleges and universities to improve their dealings with disciplinary treatments and fully respect students'legitimate rights and interests.%高校在处理违纪学生时仍存在着重实体、轻程序，重结果、轻证据的不良倾向，在一定程度上侵犯了学生的合法权益，特别是参与性的程序权利，也导致由此引发的纠纷不断。在法治理念和程序正义的指引下，在阐明正当程序意义和价值的基础上，健全高等学校学生纪律处分的一般程序，有利于维护学生合法权益。
