商标价值维持视角下的无主商标处置

摘要

The existence of the derelict trademark is an objective fact,which not only causes the waste of trademark resources,but also leads to the low efficiency of the trademark examination,the difficulty of the affirmation of trademark infringement and so on. We should maintain the value of der-elict trademark that has formed and the normal order of market competition,on the basis of the clarifi-cation of the concept of derelict trademark,by taking measures such as avoiding or reducing the pro-duction of derelict trademark in advance,finding and identifying derelict trademark timely and nation-alizing and utilizing derelict trademark afterwards and so on,thus to maintain the value of trademark and the normal market competition order.%无主商标的存在，不仅造成商标要素资源的浪费，还引发商标审查效率低下、商标侵权认定难度增大等弊端。应当在厘清无主商标概念的基础上，以维持商标价值和实现商标识别功能为基本原则，有针对性地根据无主商标产生的原因，通过事前防范以避免或减少无主商标的产生、事中及时发现和认定无主商标、事后将无主商标收归国有再行利用等措施，维持无主商标业已形成的价值，维护正常的市场竞争秩序。
