汉代官吏的经学化及其经学刑德观的形成

摘要

In the middle duration of Han dynasty,the Wu emperor of Han dynasty attached importance to Confucianism,the development of the Confucian thoughts,under the influence of the Han dynasty“Jing xue”scholars.The implementation of the Confucian ideology of politics and law practice created conditions.Confu-cian thoughts of Han dynasty promoted the Han dynasty of legal and moral legalization.It made the harmonious of Confucian legal thoughts and traditional law culture,which gives special contribution towards promoting poli-tics society and traditional law culture.%两汉时期，随着儒家经学的发展，在以经治国的影响下，汉代士人和官僚不断晓习儒经，由此开创了汉代官僚集团及汉代政治文化经学化的格局。这对实施经学意识形态的政治、法律实践创造了条件。在经学的侵润和熏陶下，汉代官僚的经学刑德观也不断渗透到汉代政治与法律体系之中，推动了汉代法律道德化，道德法律化以及法律经学化。它使儒家经学刑德观成为封建法律的灵魂，对汉代及其后世的立法、司法和狱政等都产生了重大而深远的影响。
