公诉案件繁简分流机制的理论与实践

摘要

The reform to dividing mechanism of complex and simple public prosecution case is an important content of the procuratorial reform.There are many shortcomings of the existing system design.Sichuan Guang’an’s reform practice, overcomes the shortcomings of the existing system,beyond the j udicial practice all over.Combined with the requirements of j udicial reform and modern advanced management idea,we should from split principle,classification,mechanism,efficiency and quality of handling a case split,litigation documents making,procuratorial organs of internal examination and approval procedures,the system of non-prosecution,the prosecution trial work to improve the overall.%公诉案件繁简分流机制改革是检察改革的重要内容。现有制度设计存在诸多不足。四川广安的改革实践，克服了现有制度的不足，超越了各地司法实践。结合国家司法改革要求和现代先进管理理念，应从分流原则、分类标准、办案机构、分流效率和质量、诉讼文书制作、检察机关内部审批程序、不起诉制度、公诉人庭审工作等方面予以全面完善。
