CBA 裁判自由裁量权的失范与规制

摘要

Depending on the discretion theory in jurisprudence as the theoretical basis, the paper elaborates the connotation and principle of basketball referees’ exercise of discretion, and it further analyzes CBA referees’ discretion anomie phenomenon and its causes, suggesting some measures as follows: urgent need for pushing the referee profession-alization process, promoting referees’ professionalism, referee ability and psychological quality, building the multi-di-mensional supervision system to control their discretion, perfecting legislation to introduce judicial intervention so as to regulate their discretion proposal.%以法理学有关自由裁量权理论为理论基点，对篮球裁判自由裁量权的内涵及行使原则进行阐述，深入分析了 CBA 裁判自由裁量权失范现象及其原因，并提出 CBA 急需推行裁判职业化，提升裁判职业素养、执法能力、心理素质，建全多维立体监督体系，严控自由裁量行使空间，完善立法，寻求司法介入等路径来规制裁判自由裁量权的建议。
