试论残疾赔偿金和死亡赔偿金的分割——以二者的性质为基础展开

The issue of separation of disability and death damages during dispute of personal injury is still heing debated. In some people＇s opinions, the two damages could be cut, but others disagree. Whether they can be cut or not, it depends on their nature. Disability damages is a kind of compensation for foreseeable income in future, which emphasizes guaranteed hylic compensation. So couples can make use of these damages, which can not be cut when they divorce. Death damages is a kind of hylic compensation for close relatives, not heritage, which makes the death damages unsuitable as heritage for separation or debts to meet.%人身损害赔偿纠纷中，人们对残疾赔偿金和死亡赔偿金能否分割一直存在争论，有人认为这两种赔偿金是可以分割的，也有人认为它们是不可以分割的。能否进行分割取决于二者的性质：残疾赔偿金是对未来的可预见性收入的赔偿，重点强调的是保障性物质赔偿，所以夫妻可共同使用，但不能在离婚时分割；死亡赔偿金是对近亲属的物质性赔偿，不是遗产，因此不能作为遗产分割、清偿债务。
