本文通过对外交保护与领事保护的对比，分析了外交保护和领事保护在国际法上的不同作用，旨在探讨如何发展国际法，使国际法更好地调整新形势下的全球关系，尤其是在保护本国国民在海外合法权益和人身安全方面发挥更大的作用。突破传统国际法在外交保护方面的局限，高效利用领事保护的优势，配以国内立法的自主快捷，是本国国民在海外安全保障的最佳途径。%With a comparison of diplomatic protection and consular protection, this article discusses different functions of the two in international law, aiming to explore how to develop international law, how to have it better adjust different relations around the globe in the new situation, and especially how to bring it to greater play in protecting nationals＇ legal rights and interests and personal safety overseas. The best ways to protect nationals＇ overseas safety include a breakthrough of the limit of traditional approach to intemational law in diplomatic protection and efficient utilization of consular protection, as well as fast and independent domestic legislation.
