重构侦查价值--在刑事司法制度领域中探讨

摘要

The value of criminal investigation is a problem which has been discussed many times in the theory and practice of criminal investigation. It caused a lot of controversy as a result of the different values of litigation and criminal investigation. But the current research on the value of criminal investigation not only has not formed a system, also did not jump out the metaphysical thinking mode that takes the matter on its merits. This paper considers that we should discuss the value of criminal investigation under the criminal justice system. This paper also presents the specific values of criminal investigation in the criminal justice system and discusses the specific methods to achieve these values in order to maximize the objective function.%侦查价值是侦查理论与实务界讨论较多的问题，由于诉讼价值与侦查本身价值观的不同而引发了许多争论。但目前的侦查价值研究不仅尚未形成体系，也未跳出就事论事的形而上学思维模式。因此，有必要在刑事司法领域之下探讨侦查价值问题，提出刑事司法领域中侦查的具体价值，讨论实现这些价值的具体方法，以达到使其发挥最大功能的目的。
