非诉行政执行制度的目标模式和完善途径

         

摘要

非诉行政执行的案件远远高于行政诉讼的案件,但是这并不意味着非诉行政执行中当事人对于行政决定是持认可态度。行政诉讼法出于充分保障公民救济权利的需要,将行政诉讼的起诉期限延长至6个月,于此同时,如果单行法没有对行政诉讼的起诉期限另作规定,行政机关若要申请法院强制执行,将要等待法定期限届满,这无疑是对行政效率的延误。我国非诉行政执行应改变行政机关申请法院强制执行的期限规定、完善申请法院强制执行前的催告程序、扩展间接强制执行的种类和实施主体。%Non-litigious administrative execution cases are much more than administrative litigation cases, which does not mean that the parties hold positive attitude to administrative litigation. For sake of guaranteeing the public’s remedy right, the administrative litigation deadline has extended to 6 months. Meanwhile, if the special law has no relevant provisions on the administrative proceedings prosecution deadline, the administrative organ will be waiting for the expiration of the legal time limit to apply to court for compulsory execution, which is undoubtedly the delay of the administrative efficiency. Therefore, it is expected for China to change the related provisions so as to perfect the notice procedure, the indirect enforcement types and the implementation main body.
