试论我国法律援助条件的立法缺陷及完善

摘要

我国法律援助立法没有明确“法律援助条件”这一概念的内涵，导致法律援助机构在审查法律援助申请时缺乏明确的法律依据，影响了审查工作的统一性、公正性。需要从法律援助的对象、事项、管辖等方面完善现有规定，以统一法律援助申请审查工作的尺度。%Our country’ s legal aid legislation has not make clear the connotation of the legal aid condition, resulting in the lack of a clear legal basis when legal aid agencies examine the application for legal aid,so as to affect the unity and justice of the examination work.We should improve the exist-ing regulations on the object, matters, and jurisdiction of the legal aid , in order to abtain the same standard on the legal aid application.
