解决农村小产权房问题的理论探析

摘要

In order to resolve the increasing problems of rural limited property house, the author used social empirical and data analysis method, based on present situation of rural limited property house and the reasons for its formation, to evaluate current resolution ways to the problems of rural limited property house. The author pointed out that solving the problems of rural limited property house must be under the premise of maintaining social stability and the interests of farmers, the legalization of rural limited property house had a certain legal support, and the ban of rural collective land development lack legal basis, both aspects should be taken into consideration for solving the problems of rural limited property house.%为解决当下日渐突出的农村小产权房问题，用社会实证和资料分析的方法从农村小产权房产生的现状及原因入手对现行农村小产权房的解决方式做出评析，指出必须在维护社会稳定和农民利益的前提下解决农村小产权房问题，认为农村小产权房合法化有一定的法理支持，同时禁止农村集体土地开发缺少法理依据，应当从这2个方面解决农村小产权房问题。
