TRIPS-plus扩张的新制度经济学解析

后TRIPS时代，更为严苛的知识产权保护TRIPS-plus被强势扩张。从新制度经济学的角度分析，TRIPS-plus扩张的深层原因在于发达国家对剩余控制权的不断掠夺和发展中国家的短见选择。TRIPS-plus扩张的直接后果是知识产权保护中成本收益的严重失衡和路径依赖的明显加剧。发展中国家应在增强《TRIPS协定》完全性的基础上，逐步切断大国主导的体制转换路径，坚持知识产权保护上的实质公平，以实现自身的真正权益。%In the post TRIPS era, as more harsh protection of intellectual property rights, TRIPS-plus has been strongly expanding. Based on new institutional economics, the deep-seated reasons for TRIPS-plus’s expansion are the developed countries’ plunder of the residual control rights and the developing countries’ short sights. TRIPS-plus causes the imbalance of cost and income and the reinforcement of path dependence. Developing countries should enhance the TRIPS integrity, adhere to the substantive fairness, and cut off the system transition path to realize their own rights.
