困扰农村宅基地有效腾退的三个体制性问题

Rural homestead leases involved in exit of farmer's stock of homestead have achieved,farmers make decisions to vacate the house site is obviously performance of rational consciousness based on the comprehensive consideration of various factors.Although the influencing factors of rural residential land will be different due to the regional differences and the heterogeneity of household characteristics but the institutional factors of current rural land acquisition and use become the fundamental reason to hinder effective exit of residential land.So it must start from the problems of land acquisition and use then can provide reference basis for the policy formulation and legal changes of effective exit of residential land.%农村宅基地的腾退涉及的是农户已经取得的存量宅基地的退出,农户做出腾退宅基地的行为决策是基于各种因素综合考量的自觉理性的表现.虽然影响农户宅基地腾退的因素存在区域差异性和农户特征的异质性,但目前农村宅基地的取得和使用上的体制性因素成为阻碍宅基地有效腾退的根本原因.提出以户籍和社会保障号相结合的申请制度,宅基地申请和使用的标准应按照户和人均面积相结合的原则,建立人地挂钩制度,实现宅基地的异地腾退.
