司法保护对专利权经济价值的影响

摘要

专利权经济价值是指以专利文件为载体,以专利行政部门授予的排他性权利为核心,以司法机关的司法确认为边界,藉由权利人行使而呈现的经济价值.司法保护对专利权经济价值大小具有决定性影响,文章从权利要求覆盖宽度、 专利排他性权利及专利损害赔偿数额三方面研究了司法保护对专利权经济价值的影响.%The connotation of the economic value of the patent right is the economic value embodied in the exercise of the patent right. Such right, which is carried by patent documents, is bounded by the confirmation from the judicial authority with the exclusive right granted by the patent administrative department as its core. The judicial protection has a significant influence to the analysis of the economic value of the patent right. This paper analyses the confirmation on the coverage of claims, the confirmation on the exclusiveness of the patent right and the confirmation on the amount of patent damages from the judicial protection.
