论残疾儿童受教育权的法律保护

         

摘要

受教育权作为残疾儿童应该享有的一项基本权利,应该得到国家、社会、学校和家庭的积极保障。然而我国残疾儿童的教育面临许多问题,残疾儿童的受教育权并没有真正实现。本文从我国残疾儿童的受教育权状况入手,对残疾儿童受教育权的权利主体、权利保护依据、权利内容和权利保障等方面进行了法律分析,借鉴国外经验,提出完善立法、加强教育行政机关的执法力度、建立健全残疾儿童的义务教育督导体制、建立残疾儿童义务教育的家长参与和监督机制、健全残疾儿童义务教育的社会保障支撑体系和保障残疾儿童受教育权的法律救济途径等措施。%  The right for disabled children to receive education should be a fundamental one, which should be actively secured by nation, society, school and family. However, education for disabled children in China is faced with many problems;their right to education has not fully realized. Under the current situation of disabled children’s education right in China, this paper analyzed the subject of the right, right protection basis, content of the right and right security based on law. With foreign countries’ experience, it proposed suggestions to establish corresponding laws and regulations, enhance law enforcement of educational administrative bureaus, set up supervision mechanism of compulsory education for disabled children, and build up parents’ participation and supervision system, and improve disabled children’s social security system and secure legal remedy of their education right.
