建筑市场内部承包与挂靠、非法转包区分的研究

摘要

内部承包是建筑行业内的一种普遍作法，其与挂靠、非法转包有着一定的相似性，但却有着本质的区别。在现实的操作中，出现了大量打着内部承包名义的挂靠、非法转包的案例，这种违法操作隐蔽性高、专业性强，确实困扰着很多法律工作者。该文从建筑经济学和法律的双重角度对内部承包进行分析，对三者的特点和区别方式进行论述，找出三者之间的共性与殊性。%Internal contracting, a common practice in construction industry, shares some similarities with subordinate and illegal lip-pour ladle, but has fundamental differences. In real practices, many fraud cases are found where subordinate and illegal lip-pour ladle are adopted in the name of internal contracting. These illegal practices are highly concealed and professional, bothers numerous lawyers. Internal contracting is analyzed from the aspects of construction economics and laws, the features and distinguishing methods of the three practices are introduced with similarities and differences among them are identified.
