医院专利转化采用多重交易方式的初步探讨

摘要

Timing is one of the most important characteristics for patent.It will cause huge waste of resources if patent could not be transformed as soon as possible.Currently,the conversion rate of medical patents is very low in China.Thus,we conducted this study to analyze the international law of translational medicine,as well as the domestic policy of medium and long-term plans for scientific and technological development,and speculate the medical patent transformation pattern in China,combined with the successful patent transformation projects in Zhongshan Hospital,Fudan University in recent years.We explored the feasibility of multiple transactions,for hospital patent transformation.Through this research,we argues that one-time transaction,transform step by step,or transform in the form of equity,all of these would be the effective operations of patent transformation if used properly.%专利的“时间性”为其重要特征,若不能尽快转化是对科研资源的巨大浪费.目前,我国医学专利转化率低下.本文从国际转化医学发展规律和国内中长期科学和技术发展规划纲要推测我国医院专利转化的模式和趋势,并结合复旦大学附属中山医院近年来的成功技术转移案例,探索医院专利转化多重交易方式的可行性.通过分析,本文认为无论是一次性交易、分步骤转让还是在新的经济环境下出现的知识产权以股权形式转让等新方式,只要运用得当,均可成为医院专利转让的有效操作方式.
