论现阶段国内船舶建造合同纠纷的基本问题

Against the background of the depression in shipping industry nowadays, the number of domestic shipbuilding contract disputes begins to rise. Shipbuilding contract disputes vary in category and have different causes, which naturally result in the difficulty in the application of law. Focusing on the current issues in domestic shipbuilding contracts, this paper, based on the basic theory of civil law and exploying positive approach and comparative study, analyses such issues as the legal na- ture of shipbuilding contracts, the application of Rebus Sic Stantibus principle, the disputes of ship defect, the effect of ship- building contracts when the shipbuilder lacks relevant qualification etc. , and puts corresponding solutions.%在现阶段航运业不景气的大背景下，国内船舶建造合同纠纷案件数量出现上升态势。该类案件类型多、形成原因复杂，且在法律适用上存在诸多难点。针对现阶段国内船舶建造合同一系列基本问题，结合民法基本理论，采用实证分析、比较法等方法，分析论述了船舶建造合同法律性质、情事变更原则的适用、船舶质量瑕疵纠纷、造船方不具备相应资质情形下合同效力认定等问题，并提出应对措施。
