浅议《TBT协定》对技术法规的适用--以欧盟海豹产品案为例

摘要

EU-Seal Product is a classical case DSB of WTO applied TBT Agreement, and Also a protection issue verdict organization of WTO to deal with the protection of animal welfare for the ifrst time in the history of multilateral trading system. Based on the reports of the panel, this paper discusses how to use this Agreement in technical regulations, and puts the focus on analyzing deifnition and the principles of the necessity and non-discrimination of technical regulations.%欧盟海豹产品案是WTO争端解决机构适用《TBT协定》的一个经典案例，也是WTO裁决机构首次在多边贸易体制历史上处理动物福利的保护问题。本文结合欧盟海豹案专家组报告深入探讨该协定如何适用于技术法规，重点分析“技术法规”定义、非歧视原则和必要性原则的解释和适用。
