体育公益诉讼研究

摘要

The social value and function of sports public interest litigation is becoming more and more manifest with the development of public interest litigation and public sports service .The public welfare lawsuit in sports ,it ought to be based on analysis from the concept ,connotation and characteristics of sports public interest litigation ,civil public interest litigation form and the similarities and differences ,and reasons of foreign reference analysis and so on several aspects , the related theoretical problems of the public interest litigation in sports are explained .Based on it ,legislation and suggestions on amending the law are proposed ,public interest litigation on the sports legal system framework are constructed ,and the implementation of breakthrough path for our sports public interest litigation is made .%体育公益诉讼的社会价值和功能随公益诉讼和公共体育服务的发展愈加彰显。基于体育公益诉讼的应然分析，从体育公益诉讼的概念、内涵及特征，与民诉法中公益诉讼形式的异同，国外借鉴及原因分析等几个方面，对体育公益诉讼的相关理论问题进行解读和阐释，在此基础上，提出了立法和修法建议，对体育公益诉讼的法律制度框架进行了构建，并在实践层面给出了我国体育公益诉讼取得突破的实施路径。
