浅析矿业权私权属性和行政许可的关系

摘要

Mining right as a carrier of mineral resources, plays an importat role in mining economy. Researching on private attributes of mining right has drawn increasing attention during these years. The paper mainly discuss the relationship between mining right attributes and administrative license. The Author has explored how to administer strictly when granting mining right, and protect the interests of mining righter when transfering mining right.%矿业权作为矿产资源的载体,在整个矿业经济中起着极其重要的作用.在这样的背景下,对矿业权私权属性的研究得到越来越多的重视.本文通过对矿业权私权属性、行政许可制度体系及其两者关系的研究,分析如何在矿业权出让环节严格规范行政许可制度,在矿业权转让环节依法保障矿业权人的合法权益.
