我国矿业用地的管理较为混乱,极不利于矿产资源、土地的保护和合理开发利用.本文首先分析了我国矿业用地相关制度的基本特征和存在的问题,进而借鉴国际经验,提出了完善制度的基本原则,即应正确处理矿产资源规划和土地利用规划的关系,矿业权及对应土地使用权的出让和流转应同时进行,应分勘探开发不同阶段和分矿种正确处理矿、地之间的关系.最后提出了对应的政策建议,即加强矿业用地管理,创新矿业用地取得方式,建立矿业划拨土地流转制度,加强矿业权相邻关系制度建设.%The management of land use for the mining in China is disordered, which works against mineral resources and land protection and rational development and utilization. This paper firstly analyzes the characteristics and problems of relevant institution of land use for the mining in China,and then based on the international experiences,puts forward the principles to improve,namely,correctly handling the relations between mineral resources planning and land use planning, the leasing and transfer of mining rights and land use rights should take place simultaneously,correctly handling the relations between mining rights and land use rights on distinguishing different phases of mineral prospecting and exploitation and types of minerals. At last, the paper gives corresponding recommendations, strengthening the management of land use for mining,to innovate the ways of acquisition of land use for mining,setting up the transfer system for free land allocation for mining, and strengthening the institutions for neighborhood relations of mineral rights.
