国外发达国家煤层气资源管理制度比较及其对我国的启示

摘要

煤炭、煤层气矿权重叠作为一个突出的问题，影响了我国煤气资源勘查开发的时空布局与有效利用。对美国、加拿大、澳大利亚等发达国家煤层气勘察开发现状、煤层气所有权定位、矿业权设置以及勘探开采等方面的特点进行了介绍，结合我国煤层气法律法规和管理制度中的缺陷，提出建全煤层气法规政策、完善矿业权重叠实施细则、明确企业间合作开采指导性方案等方面建议，为进一步解决煤炭、煤层气矿业权重叠解决提供了思路。%Overlapping mineral rights between coal and coal-bed methane as a prominent issue has significant impact on the layout and effective of coal and coal-bed methane (CBM ) in China .This paper analyzed the management system of United States ,Canada ,Australia and other developed countries in CBM ,and summed up the positioning of CBM ownership , mineral right setting ,development and other aspects of the characteristics ,then made proposals of establishing a sound regulatory policies ,improving mining rights overlapping rules and defining guidance scheme between coal and CBM firms according to the defects in the coal bed gas laws and regulations and management system of our country .Base of this , provided reference of further solution about overlapping mineral rights between coal and CBM .
