关于海事行政强制执行中代履行费用问题的探讨

摘要

Focusing on the issue of charges incurred by performance on behalf of the party concerned in maritime administrative coercion, the paper starts from the legal nature of the charges and analyzes such crucial points as the legal nature, budget approval, time for collection, post-event recovery, etc. In view of the development conditions of MSA and the characteristics of such performance, the paper also provides suggestions from the aspects of the approval mechanism, time choice, means of recovery and supervision systems.%文中针对海事行政强制执行中代履行费用问题，从代履行费用的法律属性入手，对海事代履行费用的法律所属、预算核定、征收时间、事后追偿等关键点进行分析，并结合海事管理机构发展现状及代履行工作特色，在代履行费用征收的核定机制、时间选择、追偿方法、监督制度方面给出了参考建议。
