在前期对德国法定医疗保险谈判的分层框架和双重合同系统进行勾勒的基础上,本文进一步探讨该机制的若干核心特征。德国法定医保谈判以利益相关者的自治管理、平等参与、彼此制衡为基础,国家只提供法律框架和监督。分层进行的谈判结果以集体合同为主要形式,以保证医疗服务质量为重点,在维护社会公平的同时适应多变而灵活的医疗服务需求。德国自治管理下的医疗保险谈判在塑造国家、市场和医疗保险系统间的理性关系,维系医疗保险系统内部利益相关者的良性互动,以及保障医疗保险制度平稳和有效运行方面发挥着关键作用。%Following the outline of the German statutory health insurance negotiation mechanisim with multilevel framework and two competing contract systems given in the previous paper, this paper further explores its core characteristics. The negotiations are based on the self-governance, equal participation and counterbalance of stakeholders, with the state providing only the framework and legal supervision. The multilevel negotiations bring about mainly collective contracts, emphasize on healthcare equality, and promote social equity while adapt to the changing healthcare demands. The negotiation under this self-governing system contributes greatly to the rational relationships among the state, market and health insurance system, beneficial interactions among stakeholders, and finally the effective and robust health insurance system.
