FIDIC银皮书（EPC）合同条件下设计风险分析与管理

摘要

设计工作是EPC项目成功实施的最关键因素之一。在FIDIC彩虹系列中，银皮书合同条件下承包商不平衡地承担了更多的与设计相关的风险。文章列出了中国建筑企业常见的设计风险案例，全面分析与设计相关的FIDIC银皮书（EPC）合同条款，并紧扣关键三大合同要素，为防范不同阶段的设计工作风险，从合同商务实务和程序方面，提出合理化建议。%Design Work is one of the essential factors for the success of an EPC project. More risks related to design are allocat-ed to the contactor under the Silver Book of FIDIC rainbow series. The risk cases which occurred to Chinese contractors have in-dicated the importance of risk management of design work. Based on three key contract factors,risk control during various de-sign stages of EPC project can be effectively managed within the framework of contractual practice and procedures under the FIDIC Silver Book conditions,and valuable suggestions are put forward.
