论“人类共有物”中经济财货的共有性

"Common humanity" should be devided into free goods and economic goods.The argument of the co-ownership of "Com- mon humanity" always focus on free goods but economic goods.The lack of effective demonstration of co-ownership of economic goods is the key of the international disputes about the "Common humanity" today.The co-ownership-in-common of economic goods in "Common Humanity" could be assimilated in the co-ownership-in-common system in civil law:The co-ownership of economic Goods in "Common Humanity" have the facts and legal reasons which the establishment of co-ownership-in-common system of civil law needs;the implementation of the co-ownership of economic goods in "Common Humanity" require vigorous implementation of all humankind rights and obligations in Co-ownership.%＂人类共有物＂应当作出自由财货和经济财货的分类。古典自然法学家论证的是自由财货的共有性,对＂人类共有物＂中经济财货的共有性缺乏有效论证是当今国际社会中人类共有物争端的关键原因。人类共有物中经济财货的共有性可以类比民法中的共同共有制度：人类共有物中经济财货的共有具有民法中共同共有成立的事实原因和法律原因;人类共有物中经济财货共有的实现需要全人类积极履行共有权利和承担共有义务。
