党政领导干部引咎辞职程序制度规范化的路径探析

     

摘要

引咎辞职是一项相对独立,有着自身界限的制度,也是领导干部人事任免工作中问题比较突出的部分。在党内法规、国家法律两个规则系统中,引咎辞职问责机制尚未得到全面认识与应有重视,程序制度方面的建构更是受到忽视,导致实践中辞职程序混乱、违规复出现象严重。从引咎辞职的开始到终端,规范辞职前的申请程序、辞职时的决策程序、辞职后的任职复出程序,系统构建引咎辞职制度的程序与方式是解决上述问题的有效举措。建立和完善引咎辞职及其复出的程序与方式,实现引咎辞职制度的程序之治,是对当前落实领导责任、解决无人问责问题的最好回应,也是我国官员问责机制走向规范化、法治化轨道的必经路径。%Blame resignation, a relatively independent system with its own boundaries, has become a big concern in the cur-rent personnel work of cadre appointment and removal, as it has not received enough understanding and attention, not to mention the construction of the related procedural system in either the rules system of the Party or the state law system. Thus arise issues like confusion of the resignation procedure and illegal comebacks in practice. To deal with the above problems, we propose the o-verall construction of a resignation system in both procedure and method, including the application procedure before resignation, the decision procedure at resignation, and the come-back procedure after resignation. The establishment and improvement of the procedures and methods of the blame resignation and comeback system is the best response to the implementation of the lead-ership responsibility, as well as a necessary path to the standardization and legalization of the cadres resignation system in our country.
