Design of Dispute Resolution Mechanism in Revision of Chinese Construction Contract

摘要

In the "Construction Contract (Model Contract Forms)" of 1999 version, there is no system design for construction dispute alternative resolution. Therefore, this paper will give a description on the engineer's predicament (as contractual dispute mediator) through the analysis of construction contract model at home and abroad. This paper is of the opinion that expert mediation mechanism should be construction dispute alternative resolution fitted in with China. What's more, this paper elaborates some problems to be resolved in practice.
