The Company Contract in Light of the New Legal Provisions

The new social and juridical transformations occurred in Romania in the last period of twenty three years have had a particular significance that has been viewed in adopting new legislation in the area of civil law. This new achievement has had repercussions upon the commercial law, whose provisions have been also regulated by the new Romanian civil code. Due to reforming process injustice started in the early 2000's and also taking into account the transition period Romanian society still passes, it is obviously that the Romanian authorities have made huge efforts in order to harmonize the national legislation to the community acquis, on the one hand, and to update the social values the present time requires from them, on the other hand. In this respect, the legislator reappraised the old legal provisions of commercial law and comprised part of them into the new Romanian civil code entered into force two years ago. However, the general notions stated by the old commercial code of 1887 have been partially kept in the new civil code, many of them being changed.
