Since the introduction of EEDI issues are raised either with direct design consequences which ask for repair by additional regulation or with potential changes in the design process in the long term. The phase 3 EEDI ambition is an example for the potential design changes, as this ambition affects the logistically optimised higher speeds. A threat of a (reverse) modal shift appears in particular in the coastal trades. The design process refers to design vessels for the purpose of their operation rather than for trials. This ambition can easily conflict with the EEDI 'harness'. The EEDI resulting 'fixed' speed assumption is an important example next to those who directly affects the DWT. A design process aiming at these operationally fit for purpose design will be hampered. This hindrance becomes strikingly apparent in the assessment of the minimum power needed to remain manoeuvrable in adverse conditions. Here being not fit for purpose changes to unsafe. In the overall vessel acquisition process a role of independent verifiers (class and institutes) based upon transparent assessment procedures is looked for. This is to avoid either loss of IP for parties involved, or a loss of EEDI integrity due to the use of fuzzy trial procedures.
